If there is a conflict between the above-mentioned terms and the project agreement, the project agreement will take precedence.

3. Quotes, Payments, and Fees

  • Quotations will stay valid for 30 days from the date they were provided.
  • The projects usually start when a certain amount as an advance or deposit is paid.
  • Payment schedules depend on milestone payments that are listed in your contract.
  • Additional costs, like costs of the domains, plugins, themes, licensed software, advertising expenses, etc., are billed separately, unless stated otherwise.
  • Late payments can lead to extra fees, and some services can be suspended till the debt is cleared.
  • The initial payments that you pay at the beginning of the project are not refundable after work starts, unless another arrangement was made.

4. Client Responsibilities

To ensure that your project is completed on time, please adhere to the following:

  • Supply the necessary materials, pictures, logos, and feedback in the proper manner within the stipulated time frame in order to ensure that your project stays on track.
  • Make sure that the materials supplied by you are your property or you have obtained them with the necessary permissions.
  • Have a designated person who will review project progress, give feedback, and approve the project.
  • Make sure that you review the project deliverables and give feedback/approval on time.

Any delays in the feedback or material submission might result in the extension of your project deadline.

5. Project Timelines and Revisions

We aim to meet every agreed deadline and keep you informed in a timely manner. However, timelines are estimates and may shift due to scope changes, delayed client input, or factors outside our control. Each project includes rounds of revisions. Additional revisions or changes beyond the original scope may be subject to additional charges.

6. Intellectual Property

  • Your Content: Your content, including logos, images, and other assets provided by you, will remain your property.
  • Deliverable: After payment is made in full, all rights of ownership will pass to you in relation to the custom site or software that was created for you.
  • Third-party Components: Any third-party themes, plugins, frameworks, and open source components are covered under their own licenses.
  • Our Tools and Expertise: GlobynxTech owns any code, tools, procedures, and processes in place before your project.
  • Our Portfolio: Unless stated otherwise in writing, we have the right to feature your project in our portfolio.

7. Domain, Hosting, and Maintenance

Subscription fees may apply to domain registration, hosting, and maintenance. It is your responsibility to make sure that payments are made on time. Any failure to renew will lead to loss of both the domain and the service provided. Although we have backup procedures and maintain security standards, we cannot guarantee continuous service without interruptions or errors.

8. SEO and Digital Marketing Services

SEO, Social Media Marketing, PPC advertising, and conversion optimization might be impacted by algorithm changes from search engines, competition, and rules set forth by the platforms themselves. Those things are beyond our control and might affect the outcome of our services. We help increase your visibility, traffic, and lead quality; however, we cannot give you any guarantees on ranking positions, traffic numbers, or conversions. All advertising expenses are your own responsibility.

9. Hiring Services

If you hire developers or specialists through GlobynxTech, the engagement terms, rates, working hours, and duration will be defined in a separate agreement. You must agree not to directly hire our resources outside the agreed agreement without written consent during the agreement.

10. Confidentiality and Data Protection

All business information provided by you that is not public is considered to be confidential and will be used solely for the provision of the services. Personal information will be treated in accordance with our Privacy Policy and data protection laws. Both the parties undertake not to disclose any of the confidential information of the other party to third parties unless legally obliged.

11. Warranties and Disclaimers

We are committed to delivering quality work with careful coding and testing. Our services are provided “as is”. However, we cannot assure you that our website and software will be entirely error-free, bug-free, or interruption-free at all times. In addition, you get a 30-day support period post-launch to resolve any defects found within the original scope of work without any extra costs. However, anything that occurs due to third-party changes or hacking is not covered under this warranty.

12. Limitation of Liability

Subject to the limitations of relevant laws, GlobynxTech shall not be liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, lost data, or business interruption. In no event shall the liability of GlobynxTech exceed the price paid for the specific service in question.

13. Termination

Either party can end this agreement by giving 30 days’ notice in writing to the other party. Should you choose to end the project, you will be obliged to pay for any work done and any costs that have been incurred up to the date of termination.

It is important that you promise not to abuse the website, try to access the site without authorization, include any harmful code on the website, or misuse the information for illegal purposes. The website contains all rights of GlobynxTech for all information provided by the website.

15. Third-Party Links and Tools

We may have third-party links on our site and within our service, including links to e-commerce sites and payment processors. We do not control the content or services on or offered by any of these third-party sites.

16. Changes to These Terms
